Zavvi 15% off coupons now expired
It seems that despite the initial terms and conditions for Zavvi’s 15% off coupons saying that they would be valid until the end of March, The Hut Group have decided to end the promotion early.
The Britvic “Reward your Thirst” promotion page has been updated with this message:
Zavvi.co.uk (The Hut Group Ltd) has announced its withdrawal from the Reward Your Thirst collector mechanic as of 04.02.11 in accordance with the Terms & Conditions.
The web site looks like this if you are curious.
It also looks like they have revoked any previously issued coupons (none of mine are working). No word on whether they will be cancelling preorders or not, let me know what happens to any of yours.
We had some good deals I suppose.

Zavvi would be pretty stupid to just cancel those pre-orders. It’s not like I’m going to automatically re-order if they cancel mine. I’ll either buy from someone else or not at all. It’ll be money lost, for them.

I’ve just checked and my pre-order of DoW2 Retribution Collector’s Ed. hasn’t been cancelled. It’s still listed as “processing” under my account with the discounted price I got it at thanks to the coupon I used. So far, it’s looking good.

Please first note that although this may look like legal advice if you squint it isn’t.
I am fascinated by this – are there more T&Cs with the voucher? I have read over the existing T&Cs, and there does not appear to be any justification for the withdrawal of existing issued vouchers. Note that this is supported by the fact that Sky *do* list circumstances where the prize may be withdrawn.
Zavvi’s T&C’s on the Britvic site are as follows:
“15% off Vouchers may be won or can be earned through collecting points and redeeming on http://www.rewardyourthirst.com.
* Voucher is a single use voucher and can not to be used in conjunction with any other voucher offer.
* Voucher is valid from 00:00:00 01/11/2010 to 23:59:59 31/03/2011.
* Maximum Spend £100.
* There is no cash alternative and the voucher is non-transferable.
* Employees of The Hut Group, their families and agencies, and anyone directly connected with the promotion are not eligible to use voucher.
* Promoter’s address is The Hut Group, Meridian House, Gadbrook Park, Northwich, CW9 7RA. In the event of unforeseen circumstances, the promoter retains the right to offer an alternative of equal value.
* Our standard Privacy Policy and Terms & Conditions apply. See website for details”
The Zavvi site T&Cs (http://www.zavvi.com/terms-and-conditions.info) do not appear to allow for the withdrawal of vouchers, and the standard claimed ability to change the T&Cs at will
a) does not affect the transaction that granted the voucher (and it was a transaction, as it one involving monetary consideration – see Carbolic Smoke Ball), and ;
b) the T&Cs are explicit (as they must be) that “If there is any inconsistency between the terms and conditions upon which the discount codes were issued and these terms and conditions, the discount code terms and conditions prevail”, so the T&Cs at the time of sale overrule any later changes. The discount codes were granted in an explicit contract, and the T&Cs on both sites have no justification for invalidating the granted voucher code prizes after they are granted.
People with invalidated codes that you haven’t used:
You almost certainly have a cause of legal action or Trading Standards complaint. This isn’t a technical violation – if I promise you a prize in return for the purchase of item a, you purchase item a and then I agree to give you the prize (or my agent gives it to you, as in this case), destroying it later it utterly unacceptable. It isn’t Zavvi’s property to destroy any more, it’s a symbol of a contractual obligation on Zavvi’s part. I am actually a little shocked on reading both T&C documents that this has been done without any clause relating to voucher invalidation.

I don’t really see the reason to bash Zavvi here. Clearly people have been abusing the codes (i.e. making fake accounts and the like), and it’s probably cut a fair bit into their profits. If you used the codes, you most likely got a very good deal and the items at the cheapest price so why complain?
If Zavvi isn’t the cheapest for an item, shop elsewhere, simples.

I currently have Deathsmiles (£15.88) and Killzone 3 LE (£50.88) on preorder, each made using a voucher.
If they honour the orders, they’ll make £66.76 off me. If they cancel them, they’ll get nothing. Simple as that.

Glad I used all mine as fast as I could.
I’ve no idea what to think with Zavvi. I ordered some MS points, Splinter Cell Conviction and Assassin’s Creed 2 when the offer first started, and still haven’t has AC2 sent out yet.
Then again, I ordered the Bioshock 2 Rapture edition with another code at about 1am on Wednesday, and has it by Friday morning.
