Not at all. They have no obligation to sell it to us at all.

Upon pointing this out, they ignored my email entirely. I don’t have the energy to take things like this any further.

I think it is worth noting that Tesco Entertainment feel distinctly different in terms of process than Tesco, I cannot be bothered to open up another tab but I presume this is an outsourced operation.

My endeavour is on informal speaking terms with every bound.

Just heard back from Tesco:

———————————————————
Thank you for your e-mail.

Please allow me to first apologise for this matter. I completely understand how concerning it must be but hopefully I can assist.

I have contacted our Support Team and they have advised that this is a mistake and it is only the software that is being sold. It is not the price that is incorrect but the listing which I am deeply sorry about.

The actual DJ Hero 2 Party Pack (Double Deck) which includes the hardware is being sold on other sites for roughly £119.99 but at the moment we are not selling this product.

I can only apologise for the confusion caused and if there is anything else I can do please just let me know.

Kind regards,
——————————————————————

So, claiming it was a mistake in that they do not have the product for sale, so that’s that I guess.

It will say Party Pack in your order list but if you click on the item it says DJ Hero 2 Software – Tesco won’t hesistate to leave it as it is and just ship you the software.

Their Terms and Conditions seem to give them all the wiggle room they need:

“1. 4.
If, by mistake, we have under priced a product, we will not be liable to supply that product to you at the stated price, provided that we notify you before we despatch the product to you. In those circumstances, we will notify the correct price to you so you can decide whether or not you wish to order the product at that price. If you decide not to order the product, we will give you a full refund on any amount already paid for that product in accordance with our refund policy in section 6 below.”

If this was *deliberate* under pricing to draw in traffic, then that’s illegal. If it’s a genuine mistake, then they have no obligation to send you the goods.

I’ve got an email sent to them as we speak, so I’ll let you know.
